Britain's Human Rights Act 1998 is the latest in a wave of legislative and constitutional instruments that have been passed in a number of countries (including Canada, New Zealand and South Africa) and which put human rights at the top of the public law agenda. For the most part these instruments are widely welcomed by senior judges and by academic and practising lawyers, many of whom will have campaigned for their introduction. There are, however, very considerable doubts about the wisdom of these developments within the democratic tradition of government which remain unanswered. This collection of 20 essays written by an array of internationally prestigious scholars explores these reservations. All the contributors endorse the importance of human rights within any democratic system of government, but question whether the primary responsibility for the articulation of these rights ought to be taken away from the normal political processes of representative government; they also consider the constitutional implications of doing so.Specifically, the extensive shift of political authority to the judiciary which is involved in Britain's Human Rights Act is critically examined and other ways of specifying and promoting human rights in more democratic forums are considered. Particular attention is paid to the priority which should be given to economic and social rights within the new constitutional settlement. Human rights have traditionally been understood as protecting individual freedom against intrusion by the State. In this book, Sandra Fredman argues that this understanding requires radical revision. Human rights are based on a far richer view of freedom, which goes beyond being let alone, and instead pays attention to individuals' ability to exercise their rights. This view fundamentally shifts the focus of human rights. As well as restraining the State, human rights require the State to act positively to remove barriers and facilitate the exercise of freedom. This in turn breaks down traditional distinctions between civil and political rights and socio-economic rights. Instead, all rights give rise to a range of duties, both negative and positive. However, because positive duties have for so long been regarded as a question of policy or aspiration, little sustained attention has been given to their role in actualising human rights. Drawing on comparative experience from India, South Africa, the European Convention on Human Rights, the European Union, Canada and the UK, this book aims to create a theoretical and applied framework for understanding positive human rights duties.Part I elaborates the values of freedom, equality, and solidarity underpinning a positive approach to human rights duties, and argues that the dichotomy between democracy and human rights is misplaced.Instead, positive human rights duties should strengthen rather than substitute for democracy, particularly in the face of globalization and privatization. Part II considers justiciability, fashioning a democratic role for the courts based on their potential to stimulate deliberative democracy in the wider environment. Part III applies this framework to key positive duties, particularly substantive equality and positive duties to provide, traditionally associated with the Welfare State or socio-economic rights.

Krzemieniec, Volhynia 1854) delivered the lecture at the Faculty of Literature and Art, entitled Discours sur l?influence ou l?utilité des arts imitatifs (On the Influence and Use of Mimetic Arts), published in Polish under the title O wpływie i użytku sztuk naśladowniczych in ?Pamiętnik Magnety-czny Wileński? (?Vilna Magnetic Diary?) in 1816. The bicentenary of the first universi-ty lecture on the history of art at the Vil-na University is simultaneously the bicen-tenary of the research into art in Poland, Lithuania and Central-Eastern Europe. When the New Rome falls, its collapse may come from within. Unlike the majority of European writers who have written on this subject, I am fundamentally in favor of empire. Indeed, I believe that empire is more necessary in the twenty-first century than ever before. The threats we face are not in themselves new ones. But advances in technology make them more dangerous than ever before. Thanks to the speed and regularity of modern air travel, infectious diseases can be transmitted to us with terrifying swiftness. And thanks to the relative cheapness and destructiveness of modern weaponry, tyrants and terrorists can realistically think of devastating our cities. The old, post-1945 system of sovereign states, bound loosely together by an evolving system of international law, cannot easily deal with these threats because there are too many nation-states where the writ of the "international community" simply does not run. What is required is an agency capable of intervening in the affairs of such states to contain epidemics, depose tyrants, end local wars and eradicate terrorist organizations. This is the self-interested argument for empire. But there is also a complementary altruistic argument. Even if they did not pose a direct threat to the security of the United States, economic and social conditions in a number of countries in the world would justify some kind of intervention. The poverty of a country like Liberia is explicable not in terms of resource endowment; otherwise (for example) Botswana would be just as poor. The problem in Liberia, as in so many sub-Saharan African states, is simply misgovernment: corrupt and lawless dictators whose conduct makes economic development impossible and encourages political opposition to take the form of civil war. Countries in this condition will not correct themselves. They require the imposition of some kind of external authority.
