The Art of Family Mediation is a foundational text for the mediation classroom at all levels-- graduate, undergraduate, and post-graduate. Expert mediator and trainer Lynn MacBeth explains family mediation theory and technique in a clear and compelling text that blends an overview of the research and literature with her unique insights and experience in the field. To understand the magic of mediation is to understand the mysteries of family dynamics, human communication, emotional processes, and conflict management and intervention. The therapeutic aspects of mediation, together with the legal and ethical fundamentals necessary to practicing family mediation are set forth concisely in one comprehensive source, with consideration given to the laws and practices of multiple U.S. states. For students, this book provides an understanding of the evolution of thought, practices, and legislation affecting family mediation. For instructors, an organized approach to the subject with case scenarios, materials, teaching tips, and questions for discussion provides one source for an established course that has endured and evolved over a decade. Professor MacBeth designed and teaches The Art of Mediation at Duquesne Law School in Pittsburgh, Pennsylvania. She is a pioneer in the mediation movement, having first received her training from the adherents of O.J. Coogler, the father of family mediation in America. She is a graduate of the University of Pittsburgh School of Law and Chatham University in Pittsburgh, Pennsylvania. She has been a mediator, trainer, and attorney for over twenty-five years.

One can't help but see this as a response to Suzannah Lessard's The Architect of Desire. Lessard wrote of her great-grandfather's presence as being 'something dark right there in the light.' But after reading this collection of letters, it is easy to understand the affection he inspired in his only surviving son, the editor's father-in-law. Lawrence Grant White had mounted each letter in leather books and at their close wrote of the tawdry murder that has sadly overshadowed his father's accomplishment: 'On the night of June 25th, 1906... Stanford White was shot from behind by a crazed profligate [Henry Thaw] whose great wealth was used to besmirch his victim's memory.' These letters, written primarily to his mother, father, bride-to-be and great friend the sculptor Augustus Saint-Gaudens, say much more about Stanford White as a man than as an architect-although there are some rather tedious details about White's collaboration with Saint-Gaudens and the odd aside, as when America's premier neoclassicist exclaims to his father, 'Shades of Phidias protect us, there is a steam tramway running around the base of the Akropolis.' What emerges is a rather funny, boisterous, charming man, deeply concerned with the people he loved. For example, in one letter to his mother shortly after his marriage, he writes, 'I do not wish you to think that you are in the least bit less to me now than before I was married. If you have any troubles, you must always tell them to me....' Nearly every letter included architectural sketches or delightful, hirsute caricatures that are both sweet and self-deprecating, a far cry from Lessard's dark spirit.

The Law of Dreams tells the story of a year in the life of Fergus O'Brien during the Great Potato Famine in Ireland during the 1840s. It takes us from his home on a mountaintop, which he leaves after witnessing his family all burning to death - deaths which were in fact murders that committed by his landlords. From there he travels to Liverpool, then Wales and onto a harrowing boat journey across the Atlantic to America. Along the way Fergus meets all manner of people who, like himself, are all struggling to survive. He encounters violence, treachery, thieves and prostitution - at one point being groomed as a `pearl' boy. On his travels he falls in love 3 times, each time ending up with a broken heart. Fergus has very few moments of joy and often wishes it were possible to live inside his head with his dreams. Peter Behrens transports the reader back in time, to a world that was full of hardship, sorrow and tremendous losses. It teaches us how resilient the human spirit can be in order to overcome the horrors we sometimes have to face. Behrens has written a fantastic piece of historical fiction and Fergus's story will stay in my mind forever.

American Law from a Catholic Perspective Rowman & Littlefield

As Gerard V. Bradley, Professor of Law at the University of Notre Dame, asks in his foreword: "What then should one expect to learn from a volume about American law from a Catholic perspective?" His answer is a straightforward one: "One should expect a critical guide to the moral evaluation of laws," noting of the essays collected in American Law from a Catholic Perspective: Through a Clearer Lens: "The moral evaluative perspective which unfolds in succeeding pages illumines, justifies, and critiques America's laws." Edited by Ronald J. Rychlak, American Law from a Catholic Perspective is one of the most comprehensive surveys of American legal topics by a gathering of major Catholic legal scholars. Contributors explore, among other subjects, bankruptcy, bioethics, corporate law, environmental law, ethics, family law, immigration, intellectual property, international human rights, labor law, legal education, legal history, military law, the philosophy of law, property, torts, and several different aspects of constitutional law, including religious freedom, privacy rights, and free speech. Here readers will find probing arguments that bring the critical perspective of Catholic social thought to bear on American legal jurisprudence. Essays include Michael Ariens' account of Catholicism in the intellectual discipline of legal history; William Saunders' assessment of human rights and Catholic social teaching; Hadley Arkes' look at the place of Catholic social thought with respect to bioethics; Lucia Silecchia's examination of a Catholic understanding of stewardship with respect to environmental laws; Dorie Klein's consideration of the place of Catholic views on the death penalty and Eighth Amendment jurisprudence; and many others on major legal topics in American jurisprudence-and their intersection with Catholic social teaching. American Law from a Catholic Perspective: Through a Clearer Lens is essential reading for all Catholic lawyers, judges, and law students, as well as an important contribution to non-Catholic readers seeking guidance from a faith tradition on questions of legal jurisprudence. Based on well-developed and established ideas in Catholic social thought, the evaluations, suggestions, and remedies set forth offer ample food for thought and a basis for action in the realm of legal scholarship.

Matt Frei, the BBC's former Washington correspondent, goes under the skin of the nation's capital to unravel the paradoxes of the world's last remaining superpower. The paperback has been fully updated to provide a unique view into the weird, wonderful and totally bizarre workings of America's political world and the 2008 Presidential election. Imagine a city so powerful that the weapons commanded from its ministries could obliterate the globe many times over and yet so vulnerable that it cannot prevent a seventeen-year-old boy from killing half a dozen of its inhabitants in a shooting spree that lasts for a whole month. A city so rich that it spends 150 million dollars a year on corporate lunches, dinners and fundraisers and yet so poor that its streets are frequently as potholed as those of any forgotten backwater in the developing world. A city that deploys more armed officers per square mile than any other in the world but has earned the title of being its country's murder capital. A city where 565 elected Congressmen and Senators are chased, charmed, cajoled and sometimes bribed by 35,000 registered lobbyists; where the most illustrious resident travels with a fleet of planes and a small army of body guards but where the mayor for twelve years was a convicted crack addict who believed that every law in his own country was racist, 'including the law of gravity'. A city that plays host to seventeen different spying agencies, employing 23,000 agents, none of whom were able to discover a plot that involved flying civilian airliners into buildings, even though the plotters had littered their path with clues. Hard to imagine? Welcome to Washington DC: the Rome of the 21st century. Matt Frei was the BBC's Washington correspondent from 2002, and now presents BBC World News America. Now fully updated to cover the longest, most expensive and most fascintating election campaign in US history, including the astonishing ascent of Barack Obama, the first election of the internet age, the rise and fall of John McCain and Sarah Palin and the new First Family. 'Only in America' is a surprising and brilliant dissection of the most powerful nation on earth from its capital out.

America's Extreme Capitalism Wreaked Havoc on the American People -- Even Before the Bubble Burst DISCOVERING AMERICA AS IT IS, is a monumental study of the devastating effect American-style capitalism has been having on the American people -- even before the onslaught of recession. It raises serious questions not only concerning America's role as a leading model for development, but even as to its future capacity to compete due to the deterioration of its human capital resulting from anti-social domestic policies. During the era of the Soviet Union, many human rights dissidents turned to the United States to champion their cause. Many even emigrated to the USA. Few, however, have expressed the disappointment that awaited them there, and fewer still have publicly exposed their view of human rights as practiced in the U.S.. That fact, in itself, would make Discovering America As It Is an important book, written by a journalist who was expelled from the USSR for human rights activities on behalf of his native Lithuania, and who, upon arriving in America, shared a political platform with such leaders of the American Republican Party as Newt Gingrich and Phil Gramm. "America remains the destination of choice for those who wish to emigrate from their own countries. It is still like a mysterious enchantress to many," Anelauskas writes. "I write this book for them. I have now spent ten years observing American society. Not only observing, but studying, analyzing and comparing it to other societies. When I lived in the Soviet Union, I thought that the Soviet communist system was the worst possible social order. The more I scrutinize American reality, the more I realize that they are like two ends of the same stick..." Ten years' observation of American reality has led Anelauskas to conclude that the U.S. extreme capitalist system poses an even greater threat than Soviet mock-communism to the well-being of the world. He paints an extraordinary portrait of the America he discovered -- the America as it exists for most Americans. While it has been argued that capitalism in Russia failed because the Russians "didn't know how to do it," in the United States, the veritable beacon of world capitalism, capitalism does not appear to be working for most people, either -- even before the bubble burst. America's two-decades-long love affair with its free market gurus has gutted the body politic, leaving the American Dream of prosperity for the ordinary man little more than a charade the U.S. corporate, media and government elite successfully fronts to a credulous world. Twelve highly-documented chapters -- on poverty, crime, health, education, homelessness, the deterioration of the family, income inequities and the replacement of welfare by workfare -- detail the public disarray which results from an unfettered system of great wealth where the rich determine the social priorities. Even more telling than the comparison of American capitalism with communism, an issue which may -- or may not -- be moot, Anelauskas' book ceaselessly poses this question: Does capitalism have to weigh upon its people so mercilessly -- or is the American version more extreme, more pitiless than that of other industrialized nations? In thousands of citations, Anelauskas documents the precipitous plunge in living standards of American citizens, measured not only against the standards enjoyed by citizens in other capitalist countries in the industrialized world, but against their own past levels. Among the many searing results: in all categories that measure economic equity, citizens of all other industrialized countries generally fare better than do Americans. This blistering reality is culled from innumerable researches by international organizations, domestic and international NGOs, independent U.S. think tanks, journalists, scholars, and even from American government sources, documented in over 80 pages of endnotes. While most critiques focus on one social sector or another, this multidimensional study brings them all together, and the impact is staggering. What this book enables us to grasp -- intellectually and emotionally -- is the predatory and wasteful operation of unbridled capitalism in its systemic dimensions, and the needless, preventable injury it wreaks upon millions. The linkages between government, wealth, poverty and policy, the conflicts between elite interest and collective well-being, clarify as we read. Here are just a few of many mind-catching findings scattered liberally throughout the book: An American child has one chance in 432 of becoming a doctor -- but one chance in five of growing up illiterate. One in four Americans working full time does not earn enough to stay above the official poverty line. "Food insecure households" add up to over 34 million people. The notion that stock ownership is widespread in America is absolutely false -- the bottom 90 percent of Americans own 15.6 percent of stocks (including through mutual funds), while the bottom eighty percent only own three percent! Anelauskas' ominous thirteenth chapter, "The New World Order Takes Shape," elaborates the socio-military resources and paradigms which serve to entrench and extend American hegemony, as it seeks to deflect global efforts to institute the rule of international law, and to turn the world back to the rule of force. From the expropriation of Indian lands, and the exploitation of African labor, to a taste for empire which spread to the continental rim, then jumped across many waters in a hundred-year history of invasions all around the globe, culminating at last in the hegemonic military-economic grip on the world by what many in the Third World view as a Rogue Superpower -- from domestic colonialism to imperial America -- this is America as it is.

It's the end of the world as we know it...Someday soon, you might wake up to the call to prayer from a muezzin. Europeans already are. And liberals will still tell you that "diversity is our strength"--while Talibanic enforcers cruise Greenwich Village burning books and barber shops, the Supreme Court decides sharia law doesn't violate the "separation of church and state," and the Hollywood Left decides to give up on gay rights in favor of the much safer charms of polygamy. If you think this can't happen, you haven't been paying attention, as the hilarious, provocative, and brilliant Mark Steyn--the most popular conservative columnist in the English-speaking world--shows to devastating effect. The future, as Steyn shows, belongs to the fecund and the confident. And the Islamists are both, while the West is looking ever more like the ruins of a civilization. But America can survive, prosper, and defend its freedom only if it continues to believe in itself, in the sturdier virtues of self-reliance (not government), in the centrality of family, and in the conviction that our country really is the world's last best hope. Mark Steyn's America Alone is laugh-out-loud funny--but it will also change the way you look at the world.

For many North Americans, Arab-Americans are invisible, recalled only when words like 'terrorism' or 'anti-American sentiments' arise. However, people of Arab descent have been contributing to U.S. and Canadian culture since the 1870's in fields as diverse as literature, science, politics, medicine, and commerce witness surgeon Michael DeBakey, former Oregon governor Victor Atiyeh, consumer advocate Ralph Nader, and Canadian M.P. Mac Harb. Yet, while Arab-American contributions to our society are significant and Arab-Americans surpass the U.S. average in both education and economics, they still struggle for recognition and acceptance. In this volume, editor Michael Suleiman brings together 21 prominent scholars from a wide range of perspectives including anthropology, economics, history, law, literature and culture, political science, and sociology to take a close look at the status of Arabs in North America. Topics range from the career of Arab-American singer, dancer, and storyteller Wadeeha Atiyeh to a historical examination of Arab-Americans and Zionism. The contributors discuss an assortment of different communities a Palestinian refugee community in Detroit, a group of well-educated Jordanian men, and the Shi'a Muslims in order to illustrate the range of Arab emigre experience. More broadly, they examine Arabs in the legal system, youth and family, health and welfare, as well as Arab-American identity, political activism, and attempts by Arab immigrants to achieve respect and recognition in their new homes. They address both the present situation for Arab-Americans and prospects for their future. "Arabs in America" will engage anyone interested in Arab-American studies, ethnic studies, and American studies. Michael W. Suleiman is University Distinguished Professor in the Department of Political Science at Kansas State University. He has written and co-edited numerous works in the field of Arab American studies, including "U.S. Policy on Palestine from Wilson to Clinton" and "Arab Americans: Continuity and Change".

From Slave Ship to Harvard Fordham University Press

Książki / Literatura obcojęzyczna

The biography of a remarkable individual and the chronicle of a family's rise from slavery to winning the American dream. From Slave Ship to Harvard is the true story of an African American family in Maryland over six generations. The author has reconstructed a unique narrative of black struggle and achievement from paintings, photographs, books, diaries, court records, legal documents, and oral histories. From SlaveShip to Harvard traces the family from the colonial period and the American Revolution through the Civil War to Harvard and finally today. Yarrow Mamout, the first of the family in America, was an educated Muslim from Guinea. He was brought to Maryland on the slave ship Elijah and gained his freedom forty-four years later. By then, Yarrow had become so well known in the Georgetown section of Washington, D.C., that he attracted the attention of the eminent American portrait painter Charles Willson Peale, who captured Yarrow's visage in the painting that appears on the cover of this book. The author here reveals that Yarrow's immediate relatives-his sister, niece, wife, and son-were notable in their own right. His son married into the neighboring Turner family, and the farm community in western Maryland called Yarrowsburg was named for Yarrow Mamout's daughter-in-law, Mary "Polly" Turner Yarrow. The Turner line ultimately produced Robert Turner Ford, who graduated from Harvard University in 1927. Just as Peale painted the portrait of Yarrow, James H. Johnston's new book puts a face on slavery and paints the history of race in Maryland. It is a different picture from what most of us imagine. Relationships between blacks and whites were far more complex, and the races more dependent on each other. Fortunately, as this one family's experience shows, individuals of both races repeatedly stepped forward to lessen divisions and to move America toward the diverse society of today.

Multicultural Jurisprudence Hart Publishing

Książki / Literatura obcojęzyczna

As individuals travel across borders, societies have become more and more pluralistic. The result of increased migration is the interaction among cultural communities and inevitably clashes between state law and customary law. These cultural conflicts have given rise to a new multicultural jurisprudence. In this volume scholars grapple with the immense challenges judges are currently experiencing everywhere. To what the extent can and should courts accommodate litigants' request by taking their cultural backgrounds into account? This collection brings together powerful examples of the cultural defense in many countries in Western Europe, North America, and elsewhere. It shows the ubiquity of this defense, contrary to the mistaken impression that it has been invoked principally in the United States. This book makes the case for undertaking studies of the use of the cultural defense in jurisdictions all over the world where this has not been previously documented. Many of the essays concentrate on criminal cases including homicide in the context of honour crimes, provocation based on "loss of face" or witchcraft killings. Some deal with other areas of law such as asylum jurisprudence, family law, and housing policy. They show in concrete cases how cultural claims have arisen and how legal systems wrestle with these arguments. It is clear that judges have had considerable difficulty handling many of the cultural claims. The authors demonstrate persuasively the need to reconsider the proper use of cultural evidence in legal proceedings. Those interested in the ways in which expertise influences the disposition of cases will find this book compelling.
