The European Convention on Human Rights (ECHR) entered into force on 3 September 1953 with binding effect on all Member States of the Council of Europe. It grants the people of Europe a number of fundamental rights and freedoms (right to life, prohibition of torture, prohibition of slavery and forced labour, right to liberty and security, right to a fair trial, no punishment without law, right to respect for private and family life, freedom of thought, conscience and religion, freedom of expression, freedom of assembly and association, right to marry, right to an effective remedy, prohibition of discrimination) plus some more by additional protocols to the Convention (Protocols 1 (ETS No. 009), 4 (ETS No. 046), 6 (ETS No. 114), 7 (ETS No. 117), 12 (ETS No. 177) and 13 (ETS No. 187)). Any person who feels his or her rights under the ECHR have been violated by the authorities of one of the Member States can bring a case to the European Court of Human Rights, established under the Convention. The States are bound by the Court's decisions. The Committee of Ministers of the Council of Europe make sure that the decisions are properly executed. Today the Court receives thousands of petitions annually, demonstrating the immense impact of the Convention and the Strasbourg Court. Professor Grabenwarter's Commentary deals with the Convention systematically, article-by-article, considering the development and scope of each article, together with the relevant case-law and literature.

Transitional Jurisprudence and the ECHR Cambridge University Press

Książki / Literatura obcojęzyczna

The European Convention on Human Rights has been a standard-setting text for transitions to peace and democracy in states throughout Europe. This book analyses the content, role and effects of the jurisprudence of the European Court relating to societies in transition. It features a wide range of transitional challenges, from killings by security forces in Northern Ireland to property restitution in East Central Europe, and from political upheaval in the Balkans to the position of religious minorities and Roma. Has the European Court developed a specific transitional jurisprudence? How do politics affect the ways in which the Court's judgments are implemented? Does the Court's case-law itself become woven into narratives of struggle in transitional societies? This book seeks to answer these questions by highlighting the unique role of Europe's main guardian of human rights, the Court in Strasbourg. It includes a comparison with the Inter-American and African human rights systems.

Książki / Literatura obcojęzyczna

Diploma Thesis from the year 2010 in the subject Politics - International Politics - Topic: Public International Law and Human Rights, grade: 1, University of Graz (Institut für Völkerrecht und Internationale Beziehungen), language: English, abstract: This thesis deals with the isolation regime of Abdullah Öcalan, who was arrested in 1999 and since then has been imprisoned as a sole inmate in the High Security Prison of Imrali for ten years. The aim is to investigate the detention conditions imposed on the detainee and to find out about the allegations of Human Rights violations in this case of isolation. The principle of the prohibition of torture, laid down in Art.3 ECHR, serves as the basis for this research and will be analyzed, thereby clarifying the scope of protection. On the momentous occasion of the sudden end of the isolation regime in November 2009, this thesis aims at imparting a comprehensive knowledge about the development of the isolation regime, the perception of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) regarding human rights conformity as well as the controversial judgments of the European Court of Human Rights (ECtHR) and consequently the improvements that have been achieved by transferring five convicts to Imrali. The discussion of the monitoring procedure will give an insight view of the detention conditions, which will be assessed on the basis of the CPT reports and recommendations as well as the corresponding responses of Turkey. The detailed examination of the four visits that have been carried out by the CPT in 1999, 2001, 2003, and 2007 will show the different stages of the isolation regime. Since the Court holds a controversial view concerning Human Rights violations in the isolation regime, the relevance of the CPT standards will be investigated in comparison to the case law of the Court. The role of the Committee as a preventive organ in setting human rights standards and its influence on member states will be discussed as well as the dialogue between the CPT and Turkey.

Advanced Criminal Litigation in Practice Oxford University Press

Prawo, akty prawne

Produced in conjunction with the Inns of Court School of Law, the Bar Manuals are designed specifically for students on the Bar Vocational Course. The series takes a practical and accessible approach to subjects covered, placing them in context with worked examples and sample materials. This Manual provides support for the Advanced Criminal Litigation option on the Bar Vocational Course. This course goes considerably beyond the scope of the course in Criminal Litigation and Sentencing. It has a practical emphasis and concentrates on areas which are neglected in most academic criminal law courses, but which are important to the junior criminal practitioner. The first part of the manual deals with crucial areas of practice which pose problems of a tactical and /or evidential nature: disclosure; search and seizure; multiple defendants and identification. The second section covers dangerous drugs; public order offences; road traffic offences; regulatory law and the role of the European Convention on Human Rights in criminal practice. The final section is a case study with typical exhibits and explanatory text.
