We live in a world which is characterised by both a radical inequality in wealth and incomes and the accelerating depletion of scarce natural resources. One of the things that prevents us from addressing these problems, perhaps even prevents us from seeing them as problems, is our belief that individuals and corporations have claims to certain resources and income streams that are non-negotiable, even when these claims seem manifestly hostile to our collective long-term well-being. This book is an attempt to understand how, why and when we came to believe these things. This first volume traces ideas about private property and its justification in the Latin West, starting with the ancient Greeks. It follows several lines of thinking which run through the Roman and medieval worlds. It traces the profound impact of the rise of Christianity and the instantiation of both natural and Roman Law. It considers the complex interplay of religious and legal ideas as these developed through the Renaissance, the Reformation and the counter-Reformation leading on to the ideas associated with modern natural law. The first volume concludes with a close re-reading of Locke. We can find well-made arguments for private property throughout this history but these were not always the arguments which we now assume them to have been and they were almost always radically conditional, qualified by other considerations, above all, a sense of what the securing of the common good required. These arguments included an appeal to the natural law, to the dispensations of a just God, to utility, to securing economic growth and to maintaining the peace. They almost never included the claim that individuals have naturally- or God-given rights that trump the well-being, especially the basic well-being, of other individuals. In late modernity, we have lost sight of many of these arguments - to our collective loss.

Why have Americans severely limited the estate and gift tax - ostensibly targeted at only the very wealthy - but greatly expanded the subsidies to low-wage workers through the Earned Income Tax Credit, now the single largest poverty program in the country? Why do people hate the property tax so much, yet seemingly revolt against it only during periods of economic change? Why are some groups of taxpayers more obedient to the tax authorities than others, even when they face the same enforcement regime? These puzzling questions all revolve around perceptions of tax fairness. Is the public simply inconsistent? A sympathetic and unified explanation for these attitudes is based on understanding the everyday psychology of fairness and how it comes to be applied in taxation. The Andean Pact was founded in 1969 to build a common market in South America. Andean leaders copied the institutional and treaty design of the European Community, and in the 1970s, member states decided to add a tribunal, again turning to the European Community as its model. Since its first ruling in 1987, the Andean Tribunal of Justice has exercised authority over the countries which are members of the Andean Community: Bolivia, Colombia, Ecuador, and Peru (formerly also Venezuela). It is now the third most active international court in the world, used by governments and private actors to protect their rights and interests in the region. This book investigates how a region with weak legal institutions developed an effective international rule of law, why the Tribunal was able to induce widespread respect for Andean intellectual property rules but not other areas governed by regional integration rules, and what the Tribunal's experience means for comparable international courts. It also assesses the Andean experience in order to reconsider the European Community system, exploring why the law and politics of integration in Europe and the Andes followed different trajectories. It finally provides a detailed analysis of the key factors associated with effective supranational adjudication. Today's world is post-colonial and post-Cold War. These twin characteristics explain why international society is also riddled with the two major forms of injustice which Nancy Fraser identified as afflicting national societies. First, the economic and social disparities between states caused outcry in the 1950s when the first steps were taken towards decolonisation. These inequalities, to which a number of emerging states now contribute, are still glaring and still pose the problem of the gap between formal equality and true equality. Second, international society is increasingly confronted with culture- and identity-related claims, stretching the dividing line between equality and difference. The less-favoured states, those that feel stigmatised, but also native peoples, ethnic groups, minorities and women now aspire to both legal recognition of their equal dignity and the protection of their identities and cultures. Some even seek reparation for injustices arising from the past violation of their identities and the confiscation of their property or land. In answer to these two forms of claim, the subjects of international society have come up with two types of remedy encapsulated in legal rules: the law of development and the law of recognition. These two sets of rights are neither wholly autonomous and individualised branches of law nor formalised sets of rules. They are imperfect and have their dark side. Yet they can be seen as the first milestones towards what might become a fairer international society; one that is both equitable (as an answer to socio-economic injustice) and decent (as an answer to cultural injustice). This book explores this evolution in international society, setting it in historical perspective and examining its presuppositions and implications.
