Language of Law School - 2878082729

Language of Law School Oxford University Press Inc

Anyone who has attended law school knows that it invokes an important intellectual transformation, frequently referred to as "learning to think like a lawyer". This process, which forces students to think and talk in radically new and toward different ways about conflicts, is directed by professors in the course of their lectures and examinations, and conducted via spoken and written language. Beth Mertz's book is the first study to truly delve into that language to reveal the complexities of how this process takes place. Mertz bases her linguistic study on tape recordings from her first year Contracts courses in eight different law schools. She knows how all these schools employ the Socratic method between teacher and student, forcing the student to shift away from moral and emotional terms in thinking about conflict, toward frameworks of legal authority instead. This move away from moral frameworks is key, she says, arguing that it represents an underlying world view at the core not just of law education, but for better or worse, of the entire US legal system - which, while providing a useful source of legitimacy and a means to process conflict, fails to deal systematically with aspects of fairness and social justice. The latter part of her study shows how differences in race and gender makeup among law students and professors can subtly alter this process. Written within the tradition of anthropological lingustics, Mertz's work - the first to study law school in this sort of detail - will appeal to a wide spectrum of readers interested in the intersection of law, language, and society: sociolinguists; anthropologists; feminist, race, and social theorists, and law professors.

A guide to identifying, nurturing and growing our insight and creativity for more effective thinking. We know that our minds are capable of great things because, every now and then, they come out with a very brilliant idea or two. However, our minds are also tantalisingly unpredictable, spending worryingly large stretches of time idling or distracting themselves. This is a book about how to optimise these beautiful yet fitful instruments so that they can more regularly and generously produce the sort of insights and ideas we need to fulfil our potential - and achieve the contentment we deserve. We learn - among other things - how to grasp fragile and flighty thoughts before they disappear through anxiety and fear, at what times of day to try to work and for how long, how to make use of our boredom and instincts - and how to overcome timid and predictable approaches to the largest problems.

A powerful analysis of why lies and falsehoods spread so rapidly now, and how we can reform our laws and policies regarding speech to alleviate the problem. Lying has been with us from time immemorial. Yet today is different-and in many respects worse. All over the world, people are circulating damaging lies, and these falsehoods are amplified as never before through powerful social media platforms that reach billions. Liars are saying that COVID-19 is a hoax. They are claiming that vaccines cause autism. They are lying about public officials and about people who aspire to high office. They are lying about their friends and neighbors. They are trying to sell products on the basis of untruths. Unfriendly governments, including Russia, are circulating lies in order to destabilize other nations, including the United Kingdom and the United States. In the face of those problems, the renowned legal scholar Cass Sunstein probes the fundamental question of how we can deter lies while also protecting freedom of speech. To be sure, we cannot eliminate lying, nor should we try to do so. Sunstein shows why free societies must generally allow falsehoods and lies, which cannot and should not be excised from democratic debate. A main reason is that we cannot trust governments to make unbiased judgments about what counts as "fake news." However, governments should have the power to regulate specific kinds of falsehoods: those that genuinely endanger health, safety, and the capacity of the public to govern itself. Sunstein also suggests that private institutions, such as Facebook and Twitter, have a great deal of room to stop the spread of falsehoods, and they should be exercising their authority far more than they are now doing. As Sunstein contends, we are allowing far too many lies, including those that both threaten public health and undermine the foundations of democracy itself.

Legal Analyst - A Toolkit for Thinking about the Law The University of Chicago Press

Książki / Literatura obcojęzyczna

There are two kinds of knowledge law school teaches: legal rules on the one hand and tools for thinking about legal problems on the other. Although the tools are far more interesting and useful than the rules, they tend to be neglected in favor of other aspects of the curriculum. In "The Legal Analyst", Ward Farnsworth brings together in one place all of the most powerful of those tools for thinking about law. From classic ideas in game theory such as the "Prisoner's Dilemma" and the "Stag Hunt" to psychological principles such as hindsight bias and framing effects, from ideas in jurisprudence such as the slippery slope to more than two dozen other such principles, Farnsworth's guide leads readers through the fascinating world of legal thought. Each chapter introduces a single tool and shows how it can be used to solve different types of problems. The explanations are written in clear, lively language and illustrated with a wide range of examples. "The Legal Analyst" is an indispensable user's manual for law students, experienced practitioners seeking a one-stop guide to legal principles, or anyone else with an interest in the law.

This book is for you if your life is a series of shattered dreams. This book is for you if you have no dreams at all. It's for you if you've bought the lie that you'll never amount to anything. That's not true. Your life is BIG-far bigger than you've imagined. Inside these pages lie the keys to recognizing the full potential of your life. The author of this book knows about hardship. Ben Carson grew up in inner-city Detroit. His mother was illiterate. His father had left the family. His grade-school classmates considered Ben stupid. He struggled with a violent temper. In every respect, Ben's harsh circumstances seemed only to point to a harsher future and a bad end. But that's not what happened. By applying the principles in this book, Ben rose from his tough life to one of amazing accomplishments and international renown. He learned that he had potential, he learned how to unleash it, and he did. You can too. Put the principles in this book in motion. Things won't change overnight, but they will change. You can transform your life into one you'll love, bigger than you've ever dreamed.
